Right of withdrawal

According to art. 5 of Legislative Decree No. 206/2005, if the customer is a consumer (i.e., a natural person who purchases goods for purposes not related to their professional activity, or does not make the purchase indicating a VAT number in the order form to Ro. Sa. Srl), they have the right to withdraw from the purchase contract for any reason, without penalty and without specifying the reason, within 10 working days from the day of delivery, subject to the provisions below.

The right of withdrawal is subject to the following non-negotiable conditions:

• The request to exercise the right of withdrawal must be sent within the established deadlines by fax, telegram, or email. Any type of communication (including complaints) must be followed within 48 hours by a registered letter with return receipt requested; although not necessary and mandatory, a small comment on the event is appreciated. • The right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g., accessories, attached software, etc.); • The right does not apply to audiovisual products or sealed computer software (including those attached to hardware), once opened;

• The purchased goods must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend, when possible, to place it in a second box; • All return costs of the products are expressly borne by the consumer, who, through their own carrier, will arrange for their forwarding to the Ro.Sa. srl logistics structure, following the indispensable authorization for return that will be assigned by Ro.Sa srl via email along with the practice opening number; • The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer; • In case of damage to the goods during transport, Ro. Sa. Srl will notify the customer of the incident (within 5 working days from the receipt of the goods in their warehouses), to enable them to promptly report the incident to the courier of their choice and obtain reimbursement of the value of the goods (if insured); in this event, the product will be made available to the customer for return, simultaneously canceling the withdrawal request; • Ro Sa. Srl is in no way responsible for damages or theft/loss of goods returned with uninsured shipments;

Except for any restoration costs for damages ascertained to the original packaging, Ro. Sa. Srl will refund the customer the amount already paid related to the value of the goods (ancillary expenses such as transportation and cash on delivery remain excluded from the refund), within 30 days from the return of the goods, via Bank Transfer. It is the customer's responsibility to promptly provide the bank details to receive the refund (ABI Code - CAB Code - Current Account of the invoice holder).

The right of withdrawal is completely forfeited if the essential condition of the integrity of the goods (packaging and/or its contents) is lacking, in cases where Ro. Sa. Srl verifies: • The absence of the outer packaging and/or original internal packaging; • The absence of integral elements of the product (accessories, cables, manuals, parts, etc.) or abnormalities to the product itself; • Damage to the product due to causes other than its transportation.

In the event of forfeiture of the right of withdrawal, Ro. Sa. Srl will return the purchased goods to the sender, charging them for the shipping costs.
